Detecting and Responding to Trouble Unfair business practices and trade defamation can damage an individual's or company's ability to compete fairly in the marketplace. However, the presence of such activities can be difficult to establish and counteract. Arkin Kaplan Rice has established a strong reputation for helping clients develop strategies to detect unfair competitive practices and defamation, and to respond effectively to those challenges. In one particularly well-known case, we designed a strategy to detect the competitor behind a covert defamation campaign launched against the late Edmond Safra, an international banker. Our efforts led to the competitor publicly apologizing and paying millions of dollars to a charity designated by the banker. In another case, we brought suit on behalf of a former director of a major French company's subsidiary alleging that his ouster from the board was improper and the result of the Arab League Boycott of Israel. The founder of a New York Stock Exchange company sought our assistance in alleging that a former corporate joint venturer used its access to his company's methods, knowledge and skill to start up its own competitor. One of the three owners of the company that has for fifty years run the Liberian maritime and corporate registries turned to us for help in defending against claims of unfair business practices advanced by the new Government of Liberia. In these types of cases, we act swiftly and vigorously to defend our clients' rights and secure appropriate remedies. |
