Lisa Solbakken was recently quoted in P&C Specialist, a Financial Times publication, on what employees should know before signing a noncompete agreement amid the current heightened enforcement under the Trump administration’s FTC.
In the article, “What You Need to Know About Noncompetes in the Trump Era,” Lisa points out that noncompetes are often embedded in restrictive stock award agreements and warns that employees may be better off foregoing the award than signing the accompanying noncompete agreement.
Lisa also cautions employees to watch out for non-solicit agreements that operate like noncompetes in practice. “They can be just as draconian,” she tells P&C Specialist. “People need to be really careful about non-solicits these days, because employers are putting a lot of effort into creating complicated, long-term non-solicits that, as a practical matter, prohibit competition as much as a noncompete would.”
